Terms of Service

These Terms of Service ("Terms") govern your use of the FitScan application ("App") provided by VisionTools ("we", "our", or "us"). By installing or using FitScan, you agree to these Terms.
1. Service Description
FitScan is a Shopify application that provides AI-powered body measurement services. The App allows your customers to:
- Upload a front-facing photo
- Receive estimated body measurements
- View a 3D body model visualization
2. Account and Installation
To use FitScan, you must:
- Have an active Shopify store
- Install the App through the Shopify App Store
- Accept these Terms and our Privacy Policy
3. Pricing and Billing
FitScan offers the following plans:
- Starter (Free): Up to 20 body scans per month
- Growth ($49/month): Up to 500 body scans per month
- Scale ($299/month): Up to 5,000 body scans per month
All billing is processed through Shopify's billing system. You may cancel at any time through your Shopify admin.
4. Acceptable Use
You agree NOT to:
- Use the App for any illegal purpose
- Upload inappropriate, offensive, or illegal content
- Attempt to reverse engineer or copy the App
- Resell or redistribute the App's services
- Use the App to collect data without user consent
5. Measurement Accuracy
Important: Body measurements provided by FitScan are estimates based on AI analysis. Results may vary based on photo quality, lighting, and positioning. FitScan should be used as a sizing guide only and does not guarantee perfect fit.
6. Intellectual Property
FitScan, including its code, design, and AI technology, is owned by VisionTools. You are granted a limited, non-exclusive license to use the App for your Shopify store while your subscription is active.
7. Data and Privacy
Your use of FitScan is also governed by our Privacy Policy. Key points:
- We do not store customer photos or measurements
- All data is processed in real-time and deleted immediately
- We do not sell or share customer data
8. Disclaimer of Warranties
FitScan is provided "AS IS" without warranties of any kind. We do not guarantee:
- 100% measurement accuracy
- Uninterrupted service availability
- Compatibility with all Shopify themes
9. Limitation of Liability
To the maximum extent permitted by law, VisionTools shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of FitScan, including but not limited to:
- Lost profits or revenue
- Customer returns due to sizing issues
- Service interruptions
10. Termination
We may suspend or terminate your access to FitScan if you:
- Violate these Terms
- Fail to pay subscription fees
- Engage in fraudulent activity
You may uninstall FitScan at any time through your Shopify admin.
11. Changes to Terms
We may update these Terms from time to time. Continued use of FitScan after changes constitutes acceptance of the new Terms.
12. Governing Law
These Terms are governed by the laws of Canada. Any disputes shall be resolved in the courts of Canada.
